TERMS AND CONDITIONS FOR PARTICIPANTS

The purpose of these Terms and Conditions is to protect the safety of all participants, registered or otherwise. Your cooperation is greatly appreciated in helping everyone enjoy the National Geographic Earth Day Run 2017 in Singapore.

General

1. These are the terms and conditions (“Terms and Conditions“) that apply to the National Geographic Earth Day Run 2017, to be held at Gardens by the Bay, Singapore on 23 April 2017 (the “Event“), further details of which are set out at the website: http://natgeorun.sg (the “Website”). The Event comprises of one 5 kilometer fun run (limited to 2,500 participants), one 10 kilometer competitive run for men and one 10 kilometer competitive run for women (both runs combined limited to 2,500 participants only). By registering to participate in the Event, attending this Event or making Green Pledges, you agree to be bound by these Terms and Conditions. If you do not accept these Terms and Conditions, you must not register to participate in the Event, attend the Event.

2. Specific rules relating to the Event are displayed on the Website (the “Rules“) and are incorporated herein. In the event of discrepancy between these Terms and Conditions and the Rules, the Rules shall prevail. If you do not accept the Rules, please do not participate in the Event.

3. The Organiser of the Event is FOX Networks Group Singapore Pte. Ltd. (trading as National Geographic) (“Organiser”). The Organiser reserves the right to amend the Rules and/or these Terms and Conditions at any time without prior notice. Any changes will be posted either within the Rules or these Terms and Conditions.

4. In the event of any dispute regarding the Terms and Conditions, Rules, conduct of the Event, Event results, Green Pledges and any other matters relating to the Event, the decision of the Organiser shall be final and no correspondence or discussion shall be entered.

Eligibility, Registration & Participation in the Event

5. The Event is open to participants of any age. To enter, you must register online via the Website, from 26 February 2017 to 19 March 2017 or when all registration spots have been filled (whichever date is the earliest). All entrants who complete the on-line registration to participate in the Event and whose applications are accepted by the Organiser shall be referred to as “Participants”.

6. To register, you must provide your full legal name, gender, your NRIC card number or passport number, a valid telephone contact number, date of birth, email address, mailing address, and contact details of your next-of-kin (including their name, mobile number, name to be displayed on Participant’s race bib and relationship to Participant), pay the applicable registration fee (Fee) as well as any further information that the Organiser may from time to time request. You agree and warrant that you will provide complete, accurate and up-to-date information as required

7. All Participants (or, if under 18 years old, their parents/ legal guardians) will be required to properly complete and accept a Waiver & Release Form in the format specified by the Organiser. If you are under the age of 18, you will not be permitted to participate in the Event if you have not properly submitted a duly accepted Waiver & Release Form signed by you parent or legal guardian, which must be provided to the Organiser on the selected collection day for the Event rack pack.

8. Upon completion of your on-line registration via the Website, you will receive an email to validate your account. You can log in to your personalised account with your registered email address and password. You must keep all login details secure and not share them with any other person. You are entirely responsible for maintaining the confidentiality of any passwords and any activities that occur under your account. The Organiser will not be liable for any loss or damage that you may suffer due to third party misuse of your password or account.

9. Upon receipt of an email to collect the Event race pack, Participants (or any person they have nominated to collect on their behalf (“Nominee”)) will be required to collect their Event race pack (“Race Pack”) in person on 14 April 2017 and 15 April 2017. During the online registration process, Participants will be required to select the time and date that they wish to collect their Race Pack. If Participants are unable to collect the race pack on the selected day, they may nominate a nominee to collect on their behalf, provided they complete and return the requisite signed form as required by the Organiser. If a Participant or Nominee is unable to collect the Race Pack on the selected date, they will not be permitted to participate in the Event and their registration application and Fee will be forfeited.

10. Participants must comply with all further rules and regulations that apply at the Website as may be notified by the Organiser.

11. The Organiser reserves the right to cancel, postpone or change the venue, date and time of the Event.

12. In the event of inclement weather, the Organiser reserves the right to delay the commencement of the Event, or cancel the Event.

13. All Participants participate in this Event at their own risk and are solely responsible for their own safety in connection with all aspects of their participation of the Event, including without limitation, travelling to and from the Event, participating at the activities at the Event, fulfilling Pledges. For the avoidance of doubt, the Organiser will not be providing any recommended routes of access to the Event. The Organiser shall not be held responsible for the

14. The Organiser reserves the right to disqualify or exclude any person from the Event and withhold any relevant awards (if applicable) if they have reasonable grounds to believe the Participants has breached any of these Terms and Conditions and/or the Rules.

15. Eligibility may change for regulatory reasons in which case the Terms and Conditions shall be amended accordingly. You agree that the Organiser shall not be held liable in the event that any persons are subsequently excluded from the Event as a result of any regulatory direction or applicable law.

Green Pledges

16. Participants are encouraged to earn up to 5 points (“Points”) by committing to “Green Actions” (“Pledges”) via the Website. Participants may exchange their Points for green dollars that can be used during the Event, exchanged for vouchers and/or merchandise, subject to availability and subject entirely at the sole and absolute discretion of the Organiser. Prizes

17. Prizes may be awarded to the top 3 winners of the Men’s 10 kilometer run and Women’s 10 kilometer run, at the Organiser’s sole and absolute discretion (“Prizes”).

18. The nature of each Prizes is subject to change and entirely at the discretion of the Organiser. Further details regarding the Prizes are set out in the Website.

19. In all matters relating to the Prizes, the decision of the Organiser shall be final and binding. No correspondence or discussion shall be entered into.

20. Prizes will be announced by the Organiser at the event site, after the Event.

21. Prizes are non-transferable.

22. Prizes are given on an “as is” basis without warranty of any kind from the Organiser, express or implied, save where this would be contrary to applicable law. Actual Prizes given by the Organiser, and any of its sponsors, may differ from those shown anywhere on the Website, Rules or during the Event. Participants shall not make any claims or demands in this regard. The Organiser will not be liable in the event that any and all Prizes or part of any Prize is unable to be delivered or fulfilled.

Liability

23. The Organiser will assume (and by registering as a Participant you warrant) that either you have legal capacity to enter into the agreement set out in the Rules and these Terms and Conditions (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract) or, if you are under 18 years of age, that your parent or guardian has consented to your registration and accepts these Terms and Conditions on your behalf.

24. By registering as a Participant, you:

(a) warrant that you have read and understood these Terms and Conditions and the Rules and agree to be bound by them; and
(b) warrant that all information submitted by you is true, accurate, current and complete.

If you are under 18, your parent or guardian will be required to give the above warranties, on your behalf in the Parent/Guardian consent section in the Waiver & Release form.

25. The Organiser does not accept responsibility or liability for any failure to receive entries or Pledges whether caused by any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorized access to entries, server functions, virus, bugs or otherwise.

26. To the maximum extent permitted by applicable law, the Organiser shall not be liable for any damage, loss, injury or disappointment suffered by any Participant participating in the Event or associated activities (including Pledges) or as a result of inability to participate in the Event, or the acceptance or use of any Award. The Organiser is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer or mobile telephone related to or resulting from registration for or participation or downloading any materials related to the Event.

27. By registering either to participate in the Event or make any Pledges, Participants agree that no claim shall be asserted against the Organiser or any subsidiary or associated company of the Organiser, its affiliates, directors, officers, employees or agents for any and all losses, damages, rights, claims and actions of any kind (including special, indirect and consequential losses) resulting from registration for, participation in, inability to participate in the Event or Pledges, or acceptance or use of any prize.

Indemnity

28. To the maximum extent permitted by applicable law, you agree to indemnify and keep indemnified the Organiser, its officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability suffered and fees and costs incurred, including reasonable legal fees, resulting from any act, neglect or default or breach by you or any person who may be authorized by you or for whom you are responsible, of any of these Terms and Conditions and/or from any and all use of your account.

Publicity & Data Protection

29. By Participating in the Event, you agree that the Organiser may use your name and address, photographs and audio and/or visual recordings of you in any publicity or promotional material as the Organiser may in its sole and absolute discretion decide.

30. Unless otherwise indicated below, any information provided by you to the Organiser shall be subject to the following terms (which shall be in addition to and without prejudice to the terms of the Privacy Statement):

(a) The personal information and data that the Organiser collects from you in respect of your registration as a Participant will be used by the Organiser for the purposes for which it is given i.e. for the administration of your participation in the Event (whether as Participant). The Organiser may also use the information to conduct research or analysis aimed at improving our services and technologies; profiling users when pitching for sponsorship, improving our customer service standards and personalizing the contents you see on the Website.

(b) The Organiser may also use your personal information to send newsletters, promotional materials and updates to inform you of similar initiatives available from the Organiser.

(c) Any personal information collected through the Website may be stored and processed in Singapore or any other country in which the Organiser or its affiliates, subsidiaries or service providers maintain facilities and by using the Website, you consent to any such transfer of information outside of your country.

(d) Unless otherwise stated herein or in the Privacy Statement, we will not disclose your personal information outside of the Organiser and its subsidiaries and affiliates without your consent.

(e) The Organiser may engage third party service providers to provide services on our behalf such as processing and delivery of mailings, web hosting, processing transactions, customer support and research and statistical analysis. These service providers will only be allowed to access personal information to the extent required to perform their specific services. All service providers will be required to treat personal information strictly as confidential information.

(f) Participants should be aware that information and data may be automatically collected through the use of “cookies”. “Cookies” are small text files a website can use to recognise repeat users and allow the Organiser to observe behaviour and compile aggregate data in order to improve the Website and to target its advertising. Cookies do not attach to Participant’s system and damage Participant’s files. If Participant does not want information collected through the use of cookies, there is a simple procedure in most browsers that allows Participant to deny or accept the cookie feature.

(g) Notwithstanding anything in these Terms and Conditions and/or the Privacy Statement, we reserve the right to disclose personal information to:

(i) conform to legal requirements or comply with legal process (including any request from a regulatory authority);
(ii) protect and/or defend our rights, property and/or our users; and/or
(iii) protect the interests of the public and/or any of our users, employees or content on our website. We may also transfer personal information if we acquire, are acquired or merge with another legal entity. In this event, we will notify you before your personal information is transferred or becomes subject to another privacy policy.

Security of Your Personal Information

31. We use a variety of physical, technical and administrative security measures to safeguard against loss, theft, unauthorized access, use, disclosure and modification of personal information in our possession. For instance, the personal information you provide to us is stored in our computer systems which have controlled access to them and are located in password-controlled facilities. However, we cannot warrant that transmissions of data online will be completely secure, and users are urged to be cautious whenever data is being shared via the Internet.

Intellectual Property

32. You acknowledge and agree that all copyright and trade marks of National Geographic and all other intellectual property rights related to the Event including within the Website and all material or content contained within it shall remain at all times owned by the Organiser or its licensors. All material and content contained within the Website is made available for your personal non-commercial use only and may not be reproduced or retransmitted without the express written consent of the Organiser. You acknowledge and agree that where it is necessary for you to download, print or copy any such materials either from the Website or as provided by the Organiser, you are only permitted to do so for your own personal use and you may download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content on the Website is strictly prohibited.

Governing Law

33. The Rules and the Terms and Conditions shall be governed in all respects by the laws of the Republic of Singapore.

34. Each Participant is fully responsible for ensuring that his/her participation in the Event is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides. The Organiser, nor its servants or agents make any representations, express or implied, as to the lawfulness of the Event or any Participant’s participation in the Event.

35. Any provision in these Terms and Conditions that is prohibited or otherwise unenforceable in any jurisdiction, is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions in these Terms and Conditions nor affect the validity or enforceability of that provision in any other jurisdiction.
